Terms & Conditions — Photography Workshops

These terms and conditions govern bookings for photographic workshops, courses, sessions and coaching offered by Jean Christophe Lagarde.

Article 1 — Professional’s identity

These terms and conditions of sale (the “Terms”) govern sales of photographic workshops, courses, sessions and coaching offered by:

Article 2 — Purpose

These Terms define the conditions under which the professional offers and sells photographic workshops, courses, sessions, private sessions, photography training and related services, in person or remotely, on a fixed date or to be scheduled.

Article 3 — Scope

These Terms apply to bookings made directly with Jean Christophe Lagarde through his website, by email, telephone, messaging, contact form or quotation.

Every booking entails the Customer’s full acceptance of these Terms. Customers acknowledge having read them before payment or payment of a deposit.

Article 4 — Definitions

Customer: any individual or legal entity making a booking.

Participant: any person actually attending the workshop.

Fixed-date workshop: a workshop set for a specific date or period.

Workshop to be scheduled: a workshop whose date is subsequently agreed between the parties.

Article 5 — Description of services

The essential characteristics of each workshop (theme, duration, required level, participant numbers, location, content, recommended equipment and price) are specified on its presentation page, in the quotation or in pre-contractual exchanges.

Photographs, visuals and examples published on the website are illustrative and do not form part of the contract.

Article 6 — Location

Workshops may take place in a studio, outdoors or at any other location communicated to the Customer before the service.

In the event of logistical, weather, safety, authorisation or availability constraints affecting the original location, the professional may change the workshop location, provided this does not substantially alter the service.

Article 7 — Minimum and maximum participant numbers

Each workshop may be subject to a minimum and/or maximum number of participants.

If the minimum is not reached, the professional may maintain the session, offer a postponement or cancel it with a full refund of amounts paid.

Article 8 — Booking conditions

A booking becomes firm after the professional’s express acceptance and receipt of full payment or the requested deposit.

Where a deposit is paid, the balance must be settled no later than 20 days before the workshop, unless otherwise stated in the quotation or invoice.

If payment is not made within the agreed period, the professional reserves the right to cancel the booking.

Article 9 — Prices

Prices are stated in euros, including all taxes, unless otherwise specified.

Unless expressly stated, transport, accommodation, meals, specific hire costs, makeup, hair styling, styling, models, site entrance fees and any other incidental expenses are not included.

Article 10 — Payment methods

Payment may be made by bank transfer, payment link, cash or any other method accepted by the professional.

An invoice may be issued on request or where required by regulations.

Article 11 — Right of withdrawal

11.1 Workshops on a fixed date or during a fixed period

Under the applicable provisions of the French Consumer Code concerning leisure activities provided on a specific date or at specified intervals, Customers do not have a right of withdrawal for photographic workshops, courses or sessions booked for a specific date or period.

11.2 Open workshops or workshops to be scheduled

If a workshop is not booked for a specific date or period and the contract is concluded remotely with a consumer, the consumer generally has fourteen (14) days from conclusion of the contract to exercise the right of withdrawal.

Customers may exercise this right by any unequivocal statement sent to the professional’s email or postal address.

If Customers expressly request that the service begin before the withdrawal period ends, they acknowledge that, if it is fully performed before the end of that period, they will no longer be able to exercise the right of withdrawal. If the service has begun but has not been fully performed, any amount due may be calculated in proportion to what has already been provided.

Article 12 — Cancellation or postponement by the Customer

Unless specific provisions are agreed in writing:

  • cancellation more than 30 days before the service: refund of amounts paid, less any non-recoverable costs already incurred;
  • cancellation between 30 and 15 days before the service: refund of 50% of amounts paid;
  • cancellation less than 15 days before the service: no refund, unless the professional grants an exceptional commercial arrangement.

Customers may request postponement. This is not automatic and remains subject to the professional’s agreement, availability and any costs already incurred.

Customers may also propose a replacement participant, subject to the professional’s prior approval.

Article 13 — Cancellation or postponement by the professional

The professional reserves the right to cancel or postpone a service in the event of force majeure, illness, accident, unavailability of the instructor, contributor or model, weather conditions incompatible with the workshop, insufficient participant numbers or any circumstance reasonably preventing normal performance of the service.

Depending on the circumstances, Customers may be offered:

  • postponement to a later date;
  • a credit note;
  • or a refund of amounts actually paid for the cancelled service.

Any refund cannot exceed the amounts received by the professional for the service concerned.

Article 14 — Technical requirements and equipment

Participants are responsible for having photographic equipment suitable for their booked workshop, unless the professional expressly states that equipment will be lent or provided.

Participants remain solely responsible for their equipment and accessories, their transport, operation, insurance and supervision throughout the workshop.

Article 15 — Conduct, safety and exclusion

Participants undertake to behave respectfully towards the professional, other participants, models, contributors and locations used.

Inappropriate, aggressive, disrespectful, discriminatory, harassing or dangerous behaviour, or behaviour undermining the dignity of a model or third party, may result in immediate exclusion from the workshop without a refund.

Article 16 — Models, image rights and use of photographs

Where a workshop involves one or more models, Participants undertake to strictly follow the professional’s instructions concerning photography, distribution and use of the images.

Unless otherwise authorised in writing, photographs taken during the workshop are reserved for personal use, portfolios, personal communications or social media with appropriate credit. Commercial use, advertising, paid editorial use, sales, transfer to third parties, press publication or use by a brand are excluded.

Any commercial use or distribution beyond the authorised scope requires the professional’s prior written agreement and, where applicable, that of the persons whose image rights are involved.

Article 17 — Intellectual property

Content supplied or used during the workshop (materials, documents, teaching plans, text, visuals, videos, demonstrations, concepts and artistic direction) remains the exclusive property of Jean Christophe Lagarde or its respective authors.

Unauthorised reproduction, distribution, adaptation, recording, online publication or use is prohibited.

Article 18 — Liability

The professional undertakes an obligation to use reasonable means in organising and delivering workshops.

No specific artistic, commercial, professional or educational result is guaranteed, as results depend in particular on the Participant’s level, involvement, equipment, technical conditions and workshop context.

The professional cannot be held liable for damage resulting from:

  • a Participant’s fault;
  • loss, theft or damage to a Participant’s equipment;
  • delay or failure of transport, accommodation or services supplied by a third party;
  • force majeure;
  • a Participant’s improper use of images or content.

Article 19 — Personal data

Personal data collected for bookings is used to manage enquiries, quotations, invoices, workshop organisation and client relationships.

Customers are invited to consult the website’s privacy policy for information about processing, retention and exercising their rights.

Article 21 — Consumer mediation

Under the French Consumer Code, consumer Customers may use consumer mediation free of charge to seek an amicable resolution of a dispute with the professional, after first attempting direct resolution through a written complaint.

Article 22 — Governing law and jurisdiction

These Terms are governed by French law.

In the event of a dispute, the parties will first seek an amicable solution. If no amicable agreement or mediation succeeds, the dispute will be brought before the competent courts under ordinary legal rules.

Article 23 — Partial invalidity

If any provision of these Terms is declared invalid or unenforceable, the other provisions remain in full force and effect.
