Effective from 24 August 2026 — English translation updated 8 October 2026

Article 1 — Purpose and scope

These terms and conditions of sale (the “Terms”) govern distance sales of photographic prints, limited editions, artworks, calendars and other physical products (the “Products”) offered on www.lagarde-photo.com.

They apply to orders placed by consumers or non-professionals. Orders placed for a professional activity may be subject to specific conditions agreed with the Seller.

The applicable Terms are those in force when the order is placed. They are available on the Website at all times and may be saved or printed. Customers must read and accept them before confirming an order.

Article 2 — Seller’s identity

Article 3 — Products and essential characteristics

Each Product page presents its essential characteristics: photograph, edition type, dimensions, medium, paper, finish, whether it is signed, any numbering, price and availability.

Prints may be produced after an order is placed by a photographic laboratory in France. Some artworks are offered as limited editions or unique pieces. The number of copies and available options are then specified on the Product page.

Customers must check characteristics and dimensions before ordering. Images displayed on a screen may show slight differences in brightness or colour depending on the equipment used. Such differences do not reduce the Customer’s right to receive a Product conforming to its description and contractual characteristics.

A request for a size, finish, frame, inscription or dedication outside the catalogue’s standard options is a special request. It must be accepted in writing by the Seller before the order and may require a quotation.

Article 4 — Prices, taxes and charges

Prices are stated in euros, including all taxes at the rate applicable on the order date. The Seller may change prices at any time, but the price charged is the one displayed when the order is confirmed.

Preparation and delivery charges and, where applicable, the selected options are shown before final order confirmation. The total amount payable is summarised before payment.

For delivery outside the European Union, customs duties, import taxes or local charges may be requested by the authorities or carrier. Unless otherwise stated, these charges are not included in the price and are payable by the recipient.

Article 5 — Orders

Customers select Products and any options, add them to the basket, provide the information required for billing and delivery, choose a delivery and payment method, then check their order summary.

Before confirming, Customers may correct any errors. They must accept these Terms and acknowledge that the order entails an obligation to pay. Confirmation is made using a button labelled “Order and pay”, “Order with obligation to pay” or similar unambiguous wording.

An order becomes final after payment confirmation or, for a bank transfer, actual receipt of the funds, followed by the Seller’s confirmation email summarising the order and contractual information.

The Seller may refuse or cancel an order for a legitimate reason, including unavailability, an obvious pricing error, declined payment, suspected fraud or an unresolved dispute over an earlier order. Any amount already received for an order cancelled by the Seller is refunded.

Article 6 — Payment

The price is payable in full when ordering, using one of the methods offered on the payment page:

  • bank card, with secure payment processed by Stripe;
  • bank transfer.

For bank transfers, bank details and the reference to quote are provided during the order process. Product preparation or dispatch begins only after funds have been received.

The Seller does not access the full bank card number. Payment is processed by the payment provider under its own security measures. An electronic invoice is supplied to the Customer.

Article 7 — Availability

Offers remain valid while displayed on the Website, subject to stock, the number of copies in an edition or the artwork’s availability.

If a Product becomes unavailable after ordering, the Customer is informed as soon as possible. They may accept an equivalent solution offered by the Seller or have the unavailable Product cancelled and refunded.

Article 8 — Delivery

Products are delivered to destinations for which a delivery method is offered when ordering. Geographic restrictions and charges are displayed no later than the start of checkout or in the basket.

Customers must provide a complete, accurate address and a telephone number allowing delivery. An incorrect or incomplete address may result in the actual cost of a new dispatch being charged, after the Customer has been informed.

Unless a different period is stated on the Product page, allow up to three working days for production or preparation, plus the carrier’s estimated transit time: generally one to three working days within France and six to ten working days for international shipments. These estimates do not replace the delivery date or period communicated when ordering.

If no agreed date or period is specified, the Product is delivered without undue delay and no later than thirty days after the contract is concluded. In the event of delay, the Customer has the rights provided by Articles L216-1 and following of the French Consumer Code, including termination after asking the Seller to deliver within an additional reasonable period, except where immediate termination is permitted.

Orders containing several Products may exceptionally be delivered separately. The Customer is informed, without any additional charge they have not accepted.

Article 9 — Transfer of ownership and risk

The Seller retains ownership of the Products until the price has been paid in full.

Where the carrier is offered by the Seller, risk of loss or damage passes to the Customer when they take physical possession of the Product. If the Customer independently chooses a carrier not offered by the Seller, risk passes when the Product is handed to that carrier.

Customers are invited to check the parcel and Product on receipt. Any damage should be reported to the Seller as soon as possible through the contact form, with the order number and, if possible, photographs. Failure to make an immediate reservation does not remove the consumer’s statutory guarantees.

Article 10 — Right of withdrawal

Under Article L221-18 of the French Consumer Code, consumer Customers have fourteen calendar days from receipt of the Product to notify their decision to withdraw without giving a reason.

This right applies to Products in stock and prints selected from the catalogue’s standard sizes, papers and finishes, without any requested personalisation. Production of a standard print after ordering does not by itself make it non-refundable.

Under Article L221-28 of the French Consumer Code, the right of withdrawal is excluded for Products made to the Customer’s specifications or clearly personalised, including:

  • a bespoke size not offered in the catalogue;
  • a specially requested finish or frame;
  • an inscription, personalised dedication or individual modification.

The exclusion is clearly stated before ordering. It does not apply to a defective, damaged or non-conforming Product.

Customers may exercise their right using the online function and model form on the Returns & Refunds page, or any unequivocal statement sent to the Seller before the period expires.

Article 11 — Returns and refunds

After notifying withdrawal, the Customer must return the Product within fourteen days to:

Jean Christophe Lagarde
200 rue de la Croix Nivert
75015 Paris, France

The Customer bears the direct costs of a withdrawal return. The Product must be properly protected. Tracked delivery insured for its value is recommended for photographic prints and artworks.

Customers may handle the Product as necessary to establish its nature and characteristics. They may be liable for diminished value caused by handling beyond what would be permitted in a shop.

The Seller refunds amounts paid, including initial delivery costs for the standard delivery method offered, within fourteen days of being informed of withdrawal. The refund may be withheld until the Product is received back or proof of dispatch is received, whichever occurs first.

Refunds use the same payment method as the order unless another method is expressly agreed, without additional charges. Any supplement for delivery more expensive than the standard method offered is not refunded.

Where a Product is defective, damaged during transport or non-conforming, the Customer does not bear the return costs necessary to implement statutory guarantees.

Article 12 — Statutory guarantees

The Seller is responsible for the statutory guarantee of conformity and the guarantee against hidden defects under the conditions provided by law.

Professional responsible for guarantees: Jean Christophe Lagarde, 200 rue de la Croix Nivert, 75015 Paris, France — Telephone: +33 6 03 98 56 09 — Contact form.

STATUTORY GUARANTEE OF CONFORMITY AND GUARANTEE AGAINST HIDDEN DEFECTS

Consumers have two years from delivery of the goods to invoke the statutory guarantee of conformity if a lack of conformity appears. During this period, consumers need establish only the existence of the lack of conformity, rather than the date on which it appeared.

Where the sales contract provides for continuous supply of digital content or a digital service for more than two years, the statutory guarantee applies to that content or service throughout the agreed supply period. During this period, consumers need establish only the existence of the lack of conformity affecting the content or service, rather than when it appeared.

The statutory guarantee of conformity requires the professional, where applicable, to supply all updates necessary to maintain conformity of the goods.

The statutory guarantee of conformity entitles consumers to repair or replacement within thirty days of their request, free of charge and without significant inconvenience.

If goods are repaired under the statutory guarantee of conformity, the original guarantee is extended by six months.

If a consumer requests repair but the seller requires replacement, the statutory guarantee of conformity is renewed for two years from the replacement date.

Consumers may obtain a price reduction while keeping the goods or terminate the contract and receive a full refund upon returning them if:

  1. the professional refuses to repair or replace the goods;
  2. repair or replacement takes place after thirty days;
  3. repair or replacement causes significant inconvenience to the consumer, particularly if the consumer permanently bears the costs of taking back or removing non-conforming goods, or the installation costs of repaired or replacement goods;
  4. the lack of conformity persists despite the seller’s unsuccessful attempt to remedy it.

Consumers are also entitled to a price reduction or contract termination where the lack of conformity is sufficiently serious to justify an immediate reduction or termination. In that case, they need not first request repair or replacement.

Consumers are not entitled to terminate the sale if the lack of conformity is minor.

Any period during which goods are unavailable for repair or replacement suspends the remaining guarantee until the repaired goods are delivered.

The rights above arise from Articles L217-1 to L217-32 of the French Consumer Code.

A seller who obstructs implementation of the statutory guarantee of conformity in bad faith may incur a civil fine of up to €300,000, which may be increased to 10% of average annual turnover under Article L241-5 of the French Consumer Code.

Consumers also benefit from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code for two years from discovery of the defect. This guarantee entitles them to a price reduction if they keep the goods or a full refund upon returning them.

To invoke a guarantee, Customers contact the Seller with their order number and a description of the defect. Photographs may be requested to facilitate processing, without depriving Customers of their rights.

Article 13 — Liability and force majeure

The Seller is responsible for proper performance of contractual obligations under the conditions provided by law. However, the Seller cannot be held liable for non-performance attributable to the Customer, an unforeseeable and insurmountable act of a third party to the contract, or force majeure within the meaning of Article 1218 of the French Civil Code.

The Seller strives to maintain access to the Website but cannot guarantee permanent availability. A temporary interruption due to maintenance, a technical incident or an external event does not affect rights attached to orders already concluded.

Article 14 — Intellectual property

Buying a print, artwork or Product transfers ownership of the physical medium after full payment, but does not transfer copyright in the photograph reproduced.

Without prior written permission, any reproduction, digitisation, modification, distribution, commercial use, creation of derivative products or public making available of the photograph is prohibited. Customers retain the right to display purchased prints in a private setting.

Article 15 — Personal data

Data collected is necessary to manage orders, payments, deliveries, invoicing, returns, guarantees and client relationships. Information about processing, recipients, retention periods and individual rights is available in the privacy policy.

Article 16 — Evidence and contract archiving

Computer records kept under reasonable security conditions constitute evidence of communications, orders and payments, without depriving Customers of the opportunity to provide contrary evidence.

Electronic contracts for amounts of €120 or more are archived for the statutory period of ten years. Customers may request access to an archived contract through the contact form, providing their identity and order number.

Article 17 — Complaints and consumer mediation

If a difficulty arises, Customers must first send the Seller a written complaint through the contact form or by post to seek an amicable solution.

After a prior complaint remains unresolved, consumers may refer the matter free of charge to:

La Société Médiation Professionnelle
Alteritae
5 rue Salvaing
12000 Rodez, France
www.mediateur-consommation-smp.fr

Article 18 — Governing law and jurisdiction

These Terms and the resulting contracts are governed by French law. For consumers resident in another country, this choice does not deprive them of protection under applicable mandatory provisions in their country of residence.

If no amicable resolution or mediation succeeds, disputes fall within the courts competent under the applicable legal rules. Nothing in these Terms restricts consumers’ right to bring proceedings before the competent court.
